“PROJECT SURVIVAL” ONLINE AGREEMENT AND RELEASE

DO NOT SUBMIT THE ONLINE APPLICATION UNTIL YOU HAVE READ THIS “ONLINE AGREEMENT AND RELEASE” COMPLETELY AND UNDERSTAND AND AGREE TO THE TERMS SET OUT IN THIS ONLINE AGREEMENT AND RELEASE

As an inducement to Surrender Productions Inc. (the “Producer”) considering me as a participant in the television program currently entitled “Project Survival” (the “Program”) and by agreeing and acknowledging in the Online Application that I have read and understand the Online Application, and this Online Agreement and Release (collectively, the “Application”), I represent, warrant and agree as follows:

1. I have answered all questions honestly and to the best of my ability.
 
2. I understand and acknowledge that although the Producer reviews all Applications, the Producer will be unable to reply to all applicants individually. I understand that I will only hear from the Producer if I am being considered for the Program.

3. I have read and fully understand and meet the eligibility requirements to be a participant on the Program. I understand, and represent and warrant that I meet, and will comply with, the eligibility requirements to be considered as a participant in the Program, which are as follows:  

I must have reached the age of majority in my province or territory of residence (which is 18 or 19 years, depending on jurisdiction) on January 1, 2026.

I must be a Canadian citizen or permanent resident of Canada;

I must be in good health and able to withstand the physical and mental rigour of participating on the Program;

I must be available and able to commit to all the filming days required. I understand that filming is scheduled to take place anytime between August 26 - October 7, 2026 on a continuous basis for up to 6 weeks, or on such dates to be determined by Producer in its sole discretion. If I am chosen to participate, it is my responsibility to make any necessary personal and financial arrangements with my employers and family in anticipation of my extended absence from home and work;

I must be willing and legally able to travel within Canada, on such dates and to such locations as Producer shall designate in its sole discretion;

I have not been convicted of any crime, for which I have not been pardoned, that would reasonable prevent me from participating in the Program, including due to legal, safety, or production requirements, the seriousness of which is to be determined by the Producer acting reasonably; I shall disclose to Producer if I have ever been charged with a summary conviction or indictable offence, other than minor traffic or parking violations, and whether I have ever had a restraining order entered against me, to the extent relevant to my participation in the Program. I acknowledge and understand that Producer reserves the right in its discretion to assess such disclosures for the purposes of determining eligibility requirements, based on such disclosures as well as any other details concerning my background. Without limiting the foregoing, I understand that I cannot have pending criminal charges that would prevent my participation in the Program and must disclose any past criminal record relevant to my ability to participate. I understand that Producer may disqualify any person found to be in violation of this requirement or whose criminal record or pending charges would reasonably prevent participation in the Program or pose a legitimate safety, legal, or production concern, at any time during the competition; and

Employees, officers, directors and agents of the McGillivray Entertainment Inc., the Producer and/or the broadcaster of the Program (the “Broadcaster”) and of any of their respective parents, affiliated and subsidiary companies and the immediate family (spouse, spousal equivalent, mother, father, sister, brother, daughter or son, regardless of where they live, and regardless of whether any of the above are step-relatives) or members of their same households (whether related or not) of such employees, officers, directors and agents are NOT eligible to be participants in the Program or participate in this application process. Additionally, each of McGillivray Entertainment Inc., the Producer and the Broadcaster reserves the right to render ineligible any person who either determines, in their sole discretion, is sufficiently connected with the production or distribution of the Program (including, through a connection to the Broadcaster or any sponsor of the Program or a challenge, competition or prize related thereto), such that his/her participation in the Program could create the appearance of impropriety. Without limiting the foregoing, you (and/or any person of your family or domiciled with you) are not employed or engaged and have not been previously employed or engaged by McGillivray Entertainment Inc., the Producer and/or the Broadcaster and their affiliated and parent companies within the last five (5) years, and you are not an immediate relative of any current or past (within the last five (5) years) employee of or worker for the Producer and/or the Broadcaster and their affiliated and parent companies.

I must provide current and accurate emergency contact information for at least one (1) adult individual (other than a member of my own household) who can be reached by Producer in the event of an emergency arising during the participant selection process or production of the Program, and I hereby consent to Producer contacting such individual in any such emergency.

4. I understand that my Application must be complete and submitted through the official application portal and further acknowledge and understand that the application portal will remain open at Producer’s sole discretion and may close at any time without notice. Incomplete submissions will not be reviewed or considered for participation on the Program. 

I understand that my Application has video components. By uploading my videos, it signifies my agreement to these terms and conditions and consenting to my videos being used for purposes related to the Program. By uploading my videos, I understand and agree that: (i) I shall not post or share my video submissions publicly at any time, including on any social media platform, website, or online forum, and any violation of this restriction may result in my immediate disqualification from the application and participant selection process, in Producer's sole discretion; (ii) If any minors appear in any of my video submissions I hereby represent and warrant that I have obtained a written release from both parents/legal guardians incorporating their agreement to these terms and conditions and consenting to the videos being used for purposes related to the Program; and (iii) I will not publicly discuss, reference, or disclose my participation in this application process, including on any social media platform or public forum, without the prior written consent of Producer.

5. Producer reserves the right to introduce other application methods in its sole discretion and the closing dates for such methods will be as stated in the relevant promotion. Producer reserves the right to change the production schedule at any time.  Producer reserves the right to change the eligibility requirements and any other application rules and rules related to the Program in its sole discretion at any time with or without notice on a specific, case-by-case basis or across the entire application pool.  Producer also reserves the right to not hold any participant applicant auditions, or to modify the manner in which it conducts participant applicant auditions, or to not produce the Program at all.

6. Producer, its agents and sub-contractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any online Applications, telephone networks, line, system, server, provider or otherwise that may result in any applications not being properly received.

7. Any Applications received after the closing date will not be considered except in Producer’s sole discretion.

8. If at any stage I cannot be contacted by Producer for any reason, fail to respond to Producer’s notification within three days of initial contact by Producer, am ineligible or choose not to participate, unavailable to travel and/or participate during the production period, or otherwise fail to comply with any rules, I will not be eligible to be a participant and Producer may select an alternate or another applicant.

9. I understand and acknowledge that multiple participants will have the chance to win a cash prize and/or other such prizes, that may be shared (“Prize(s)”) as may be available in Producer’s and/or Broadcaster’s discretion, and as such, the Prizes may be shared equally among all such individuals who have met the Producer requirements. Prizes will not be awarded until after the broadcast of the final episode of the Program and in accordance with the procedures established by Producer, in its sole discretion. Prize terms, conditions, and prize amounts will be set out in the Participant Agreement to be executed prior to and as a condition of participation in the Program.

10. I understand and acknowledge that submission of the Application and compliance with the above eligibility requirements does not in any way constitute an offer to appear on the Program nor does it guarantee that I will receive an audition or the chance to participate in the Program. The Producer may (but may not) invite me to attend an audition at Producer’s sole discretion. When selecting applicants for the Program, the following issues will be taken into account: skill, enthusiasm, drive, love of the outdoors, physical and mental resilience, and ability to adapt to remote wilderness conditions, desire to change my life. The Producer's decision regarding selection of applicants for the Program is final and absolute and not subject to inquiry or challenge.
 
11. I acknowledge that: (i) I have read, understand, am satisfied and agree to be bound by the eligibility requirements set forth in this Application; (ii) I have answered the questions in this Application honestly, accurately and completely; (iii) if any of the information in this Application is found to be false or incomplete, this will be grounds for dismissal from the participant selection process and/or from the Program, if selected, and may also result in the forfeiture of any prizes or other items I may have been awarded, if any (whether or not I have already received them); (iv) even if I meet the eligibility requirements set forth herein, Producer has no obligation to interview me and/or select me as a participant; (v) I agree to keep strictly confidential all information about the Program that I acquire during the participant selection process and/or my participation in the Program; (vi) my voice, action, and likeness may be recorded as a part of this Application and participant selection process and I understand that Producer may, but is in no way obligated to, use such recordings within the Program and all related productions and publicity or in any other manner or in any Media, (as defined in Section 12 below) at the discretion of Producer, whether or not I am selected as a participant in the Program; (vii) even if I am selected as a participant, Producer has no obligation to produce the Program or conduct the competition and Broadcaster has no obligation to exhibit it, even if conducted and produced; (viii) all decisions by Producer concerning selection of the participants are final and not subject to challenge or appeal; (ix) Producer has no obligation to return any materials (including the photographs, video submission and written materials) (collectively, the “Materials”) provided by me to Producer’s representatives at any time in connection with the Application, the participant selection process, and/or the Program, whether or not I am selected as a participant, and Producer may, but is in no way obligated to, use any such Materials in the Program or in any other manner or in any Media as set out herein, and (x) Producer has the right to change any of the terms of the Application and participant selection process at any time or to select or not select anyone at its sole discretion. I warrant and represent that I have all right and authority to grant the rights in the Materials to the Producer as contemplated herein; and I shall not give or agree to give any member of the production staff and anyone associated in any manner with the Program, or any representative of the Producer or Broadcaster any compensation or anything else of value to arrange my appearance on the Program or to accept or agree to accept anything of value to promote any product, service or venture on the Program, or use any prepared material containing such a promotion.

12. I hereby represent and warrant that I am a permanent resident or citizen of Canada, or that I have the legal right to perform in the Program and take up any related prize and/or prize agreement and am able to demonstrate such right on request by Producer at any time and I agree to notify Producer immediately of any change in my immigration or residency status.

I hereby consent to the production, reproduction, broadcast, publication, exhibition, distribution, adaptation, recording, use and reuse by Producer, Broadcaster and each of their respective licensees, successors, assignees, parents, subsidiaries, or affiliated entities and each of the respective employees, agents, officers and directors of the foregoing entities (collectively, the “Releasees”) of my voice, actions, likeness, name, appearance, biographical material, and any information contained or derived from my Application, including, without limitation, any recordings or still pictures of me taken during the participant selection process and/or contained in any Materials submitted by me in connection with my Application, including any audition tape (collectively, “Likeness”), as such Likeness may be edited, altered, or modified by Releasees, in any and all media now known or hereafter devised (whether or not foreseeable), throughout the universe in perpetuity in all languages, manner or communication (“Media”), in or in connection with the Program and all related productions, publicity material, spin-offs, advertising or any other production. I agree that the Releasees may use all or any part of my Likeness and may alter or modify it regardless of whether or not I am recognizable. I further grant irrevocably to, fully assign to, and agree that, the Releasees shall own exclusively any and all right, title, and interest (including, without limitation, all copyrights) in and to the Materials, any other video, recordings or still pictures and any other materials that I have provided or may provide in connection with this Application, the Program and the participant selection process and in and to any video, recordings or still pictures taken during the participant selection process of any such materials provided by me, and acknowledge and agree that the Releasees may, in their sole and unfettered discretion, edit, alter or modify, and use all or part of all such Materials and other recordings and my Likeness in all Media. I represent and warrant (i) that everyone appearing in the Materials and anyone who may have shot or created such Materials agrees that they may be used, as edited, altered or modified by Producer or by any of the other Releasees, in all Media without any compensation, (ii) the Materials will be free from any material that are libellous, defamatory, profane, obscene, pornographic or graphically violent, and will not contain any content that is contrary to law or which places any of the participants appearing on or off camera at serious risk or harm, or contains any individuals other than myself including minors, and (iii) that I have the rights and licenses necessary to submit the Materials and grant all of the rights granted herein. I hereby expressly waive in favour of the Producer, any moral rights that I may have with respect to the audio-visual productions and/or sound recordings produced and/or recorded in the Materials or otherwise for the purposes of the Program. I grant the rights hereunder whether or not I am selected to participate in the Program in any manner whatsoever. I understand that I will not be paid any money for giving Releasees these rights, or for submitting the Application, the sole consideration for which being the Producer’s consideration of me as a possible participant in the Program, which I acknowledge is good, valuable and sufficient consideration and is hereby accepted by me.

13. I agree to take any further action, in writing (including, without limitation, entering into confidentiality agreements, executing affidavits, assignments, and/or other documents), reasonably requested by Producer to effect, perfect or confirm Producer’s and Broadcaster’s rights in the Materials and my Likeness or otherwise in connection with this Application and the rights granted by me hereunder.

 14.  I understand that the participant selection process will involve subjective decisions made by the Producer and/or Broadcaster, or those authorized on their behalf (collectively, the “Panelists”), in their sole and absolute discretion. I understand that the Panelists may make casting recommendations to the Producer and the Broadcaster but that all decisions relating to the Program, including without limitation participant selection, advancement and elimination, will be made by the Producer and/or the Broadcaster in their sole and absolute discretion. I further understand that the Panelists, the Broadcaster, the Producer and/or other persons or entities may be acquainted with or have some familiarity with some or all of the applicants to varying degrees, and I expressly waive any claim arising from such familiarity. I understand and agree that all decisions relating to the Program are final, conclusive and binding on me in all respects, and shall not be subject to challenge, appeal or review by me for any reason whatsoever and under any circumstances.  

15.  Without limiting anything in this Agreement, I hereby release the Releasees as well as any television station or channel, cable network, satellite network or any digital platform that exhibits the Program or the Materials, the other participants in the Program, the advertisers and promotional agencies connected with the Program, all other persons and entities connected with the Program, each of the respective parent, subsidiary and affiliated companies of the foregoing, and each of their respective officers, directors, agents, representatives, employees, successors, assignees, and licensees (collectively, the “Released Parties”) from any and all claims, actions, damages, liabilities, losses, costs and expenses of any kind (including, without limitation, legal fees) arising out of, resulting from, or by reason of, the Materials or my participation in or in connection with the Program, including, without limitation, my participation in the participant selection process of the Program, participation in any Program related activities, any exploitation of the Program or my appearance on the Program, the failure of Producer to select me as a participant, the cancellation of the Program, any activities in connection with the video submission, or the exercise by Producer of any rights granted by me with respect to the Program on any legal theory whatsoever (including, but not limited to, personal injury, rights of privacy and publicity, false light, and defamation) (the “Released Claims”).  The Released Claims specifically include, without limitation, any and all claims, actions, damages, liabilities, losses, costs and expenses (including legal fees) of any kind resulting from the actions of another participant or any other third party at any time. 

16.  With respect to the information provided by me in this Application, including but not limited to all “personal information” collected by Producer and/or or its authorized agents pursuant to the terms hereof:

I authorize Producer and/or its authorized agents to investigate, access and collect information about me, about any of the statements made by me in my Application, any supporting documents and any other document that I have signed or am obligated to sign in connection with my Application to be selected as a participant in the Program, or any other written or oral statements I make in connection therewith.  I irrevocably authorize Producer and/or its authorized agents to undertake background checks including, without limitation, social media checks, to secure information about my experiences from my current and former employers, associates, friends, family members, educational institutions, government agencies, credit reporting agencies, and any references I have provided, and I irrevocably authorize such parties to provide information concerning me.  In the course of these investigations, I agree that Producer and/or its authorized agents may disclose to the foregoing entities personal information that I have provided in this Application or that Producer has obtained from third parties, in the course of the investigation. I specifically authorize investigation of my employment record and government records, including, but not limited to, my motor vehicle records, civil or criminal record, credit and/or consumer report(s).

If I am selected for an audition, I understand that I may be given, and must complete and return, any further application materials (including but not limited to medical history forms, psychological and health questionnaires), or submit further documentation (such as my birth certificate and/or other identification) as may be required by Producer, in its sole discretion, for the purposes of determining if I am physically and mentally capable of participating in the Program, for casting, and other such similar decisions in connection with my Application to the Program. I hereby authorize Producer to arrange an appointment for psychological and physical examinations and to conduct background investigations of me as determined by Producer in Producer’s sole discretion.  I further authorize the individuals conducting such examinations and investigations of me to disclose to Producer and to Producer’s representatives all information about me obtained in connection with such examinations or investigations. Additionally or in the alternative (in Producer’s sole discretion), I will provide Producer with certification from my family physician (GP) stating that I have no medical condition that would prevent me from participating in the Program, and that engaging in the Program would not exacerbate any medical condition I may have.

I acknowledge and agree that any such information obtained by Producer pursuant to this section 16, this Application or otherwise may be used for the purpose of making casting and other similar decisions for the production (and public viewing) of the Program, and, with the exception of medical information, employment record and government records, may be described, disclosed or otherwise used in and in connection with the Program (by Producer or Broadcaster), any subsequent seasons of the Program, and any ancillary or related productions, including “making-of” and “behind-the-scenes” or “after show” productions, and/or for publicity and promotional purposes related thereto.

I hereby unconditionally and irrevocably release and forever discharge the Released Parties and all such parties and persons from any and all liabilities arising out of or in connection with any such investigations and arising out of the collection, use and disclosure of my personal information in the ways stated in this Application and agree not to make any claim against Released Parties in respect of such use (including, without limitation, any claim that such use invades any right of privacy and/or publicity and any claims based on defamation or false light).

17. Whether or not I am selected to be a participant on the Program, I shall keep in strictest confidence and shall not disclose to any other applicant, participant or other third party at any time (i.e. prior to, during, or after the taping or exhibition of any episode of the Program) any information or materials of any kind, including without limitation, any information or materials concerning or relating to Producer and/or Broadcaster the business of Producer and Broadcaster, any program produced by Producer and/or exhibited by Broadcaster, including, without limitation, any information concerning or relating to the Program, the Program applicants, the Program participants, the Program judges, guest appearances, the location(s) of the Program, the events contained in the Program, or the outcome of any challenge or competition in or episode of the Program, that I read, hear or otherwise acquire or learn in connection with or as a result of my applying to be a participant on the Program or (if I am selected to be a participant) as the result of my experiences as a participant on the Program (collectively, the “Information and Materials”).  I acknowledge and agree that the Information and Materials are confidential and the exclusive property of Producer and/or Broadcaster.  At no time will I ever, directly or indirectly, divulge in any manner or use or permit others to use any of the Information and Materials.

18. I acknowledge that in the event I breach the confidentiality or any other provisions of this Application, my breach may, in the sole discretion of Producer and/or Broadcaster, result in my being disqualified to participate as a participant in the Program.  I further acknowledge that a breach by me of any of the confidentiality provisions of this Application would cause Producer and Broadcaster irreparable injury and damage that cannot be reasonably or adequately compensated by damages in an action at law, and, therefore, I hereby expressly agree that Producer and Broadcaster shall be entitled to injunctive and other equitable relief to prevent and/or cure any breach or threatened breach of any of the confidentiality provisions of this Application by me. I also recognize that proof of damages suffered by Producer and Broadcaster in the event that I breach any of the confidentiality provisions of this Application will be costly, difficult, and/or inconvenient.  Accordingly, I agree to pay Producer and Broadcaster the sum of One Million Canadian Dollars (CDN$1,000,000.00) per breach plus disgorgement of any income that I may receive in connection with my breach as liquidated damages in the event I breach any of the confidentiality provisions of this Application prior to the initial public exhibition of the final episode of the Program. I agree that One Million Canadian Dollars (CDN$1,000,000.00) plus disgorgement of any income that I may receive in connection with my breach is a reasonable estimate of the amount of damages Producer and Broadcaster are likely to suffer in the event I breach any of the confidentiality provisions of this Application prior to the initial public exhibition of the final episode of the Program, considering all of the circumstances existing as of the date of this Application.  In addition, I agree to pay Producer and Broadcaster the sum of One Hundred Thousand Canadian Dollars (CDN$100,000.00) per breach plus disgorgement of any income that results from my breach as liquidated damages in the event I breach any of the confidentiality provisions of this Application after the initial public exhibition of the final episode of the Program. I agree that One Hundred Thousand Canadian Dollars (CDN$100,000.00) plus disgorgement of any income is a reasonable estimate of the amount of damages Producer and Broadcaster are likely to suffer in the event I breach any of the confidentiality provisions of this Application after the initial public exhibition of the final episode of the Program, considering all of the circumstances existing as of the date of this Application. 

19. I acknowledge and agree that (i) the provisions of this Application shall enure to the benefit of the successors and assigns of Released Parties and shall be binding upon my heirs, executors, administrators and representatives, (ii) this Application will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein and that the courts of Ontario will have exclusive jurisdiction over any matter arising out of this Application, (iii) if any provision of this Application is invalid, illegal, or unenforceable in any jurisdiction it will, as to that jurisdiction be ineffective only to the extent of such invalidity, illegality or unenforceability, without affecting in any way the remaining provisions hereof in such jurisdiction or rendering that or any other provision of this Application is invalid, illegal or unenforceable in any other jurisdiction, (iv) Producer and or Broadcaster reserve the right to change the terms and conditions of this Online Agreement and Release, the Online Application, and Producer’s Privacy Policy at any time without notice, and (v) that Releasees may freely assign, in whole or in part, any of their rights or obligations under this Application and I may not assign my rights and obligations under this Application.

THANK YOU FOR COMPLETING THIS ONLINE APPLICATION. WE WILL BE UNABLE TO REPLY TO ALL APPLICANTS INDIVIDUALLY. IT COULD BE SEVERAL WEEKS BEFORE YOU HEAR FROM US, IF AT ALL, AND YOU WILL ONLY HEAR FROM US IF WE ARE INTERESTED OR HAVE FURTHER QUESTIONS. PLEASE NOTE THAT THIS ONLINE APPLICATION DOES NOT IN ANY WAY CONSTITUTE AN OFFER TO PARTICIPATE IN THE PROGRAM. IF YOU HAVE INDICATED ON THE ONLINE APPLICATION THAT YOU WISH TO BE CONSIDERED FOR PARTICIPATION IN THE PROGRAM, YOUR PERSONAL DETAILS WILL BE INCLUDED IN A DATABASE COMPILED FOR THIS PURPOSE. IN THE EVENT THAT YOU DO PARTICIPATE IN THE PROGRAM, THEN PRIOR TO AND AS A CONDITION FOR YOUR PARTICIPATION, YOU WILL BE REQUIRED TO SIGN A SEPARATE PARTICIPANT FORM PACKAGE WHICH WILL BE PROVIDED BY PRODUCER AND WILL INCLUDE, BUT NOT BE LIMITED TO A PARTICIPANT AGREEMENT AND RELEASE, PSYCHOLOGICAL AND MEDICAL ASSESSMENTS, CONFIDENTIALITY AGREEMENT (INCLUDING THOSE FOR YOUR IMMEDIATE FAMILY MEMBERS) AND OTHER ADDITIONAL INFORMATION AS REQUIRED BY PRODUCER, INCLUDING MEETING ALL PHYSICAL AND PSYCHOLOGICAL REQUIREMENTS. SUCH AGREEMENT WILL PROVIDE THAT IN CONSIDERATION OF YOUR PARTICIPATION IN THE PROGRAM, WE WILL OWN ALL OF THE RIGHTS IN THE PROGRAM INCLUDING YOUR CONTRIBUTION WHICH WILL BE FREELY AVAILABLE FOR EXPLOITATION, INCLUDING, WITHOUT LIMITATION, FOR BROADCAST AND ALL OTHER MEDIA PURPOSES WITHOUT ANY PAYMENT TO YOU. THE INFORMATION YOU SUPPLY ON THIS ONLINE APPLICATION MAY BE STORED BY PRODUCER ON COMPUTERS AND WILL ONLY BE USED IN ACCORDANCE WITH THE FOLLOWING TERMS AND CONDITIONS AND PRIVACY POLICY. WE WILL NOT SUPPLY THIS INFORMATION TO THIRD PARTIES OTHER THAN AS IS REASONABLY NECESSARY TO SELECT PARTICIPANTS AND PRODUCE THE PROGRAM, OR AS SPECIFICALLY SET OUT IN THE TERMS AND CONDITIONS.

APPLICANTS ARE REQUIRED TO CONFIRM THEIR REVIEW AND ACCEPTANCE OF ALL TERMS CONTAINED HEREIN. CLICKING “I AGREE”, TOGETHER WITH YOUR SUBMISSION OF THIS APPLICATION, SHALL CONSTITUTE YOUR BINDING AGREEMENT TO ALL TERMS SET OUT IN THIS ONLINE AGREEMENT AND RELEASE.
